1. Agreement
These Terms of Service (“Terms”) are a contract between you and broke money, which operates afterhours.study and Afterhours (“afterhours”, “we”, “us”, “the Service”).
By accessing the website, joining the waitlist, creating an account, or using any part of the Service, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service.
2. Who may use the Service
You must be able to form a binding contract in your jurisdiction and comply with these Terms.
If you use the Service on behalf of a school, university, or other organisation, you confirm you have authority to bind that organisation and that your use complies with its policies.
Access may be invite only or limited during beta periods. We may refuse or revoke access at our discretion where permitted by law.
3. Accounts and security
You are responsible for the accuracy of registration information and for keeping your login credentials confidential.
You must notify us promptly if you suspect unauthorised access to your account.
You may not share accounts in a way that circumvents plan limits or licensing terms.
4. The Service
afterhours is a study workspace that may include notes, flashcards, course tracking, AI assisted study tools, collaboration features, and related functionality. Features vary by plan, region, and release stage.
We may add, change, or remove features. During beta, parts of the Service may be incomplete, experimental, or temporarily unavailable.
The Service is a study aid. It does not replace teaching staff, official course materials, or professional advice.
5. Acceptable use
You agree not to:
- break the law or infringe others’ intellectual property, privacy, or other rights
- upload copyrighted or restricted materials without permission, or otherwise breach academic integrity rules (see Copyright and academic integrity below)
- upload malware, attempt unauthorised access, scrape the Service at scale, or interfere with its operation
- circumvent or attempt to circumvent safeguards, usage limits, sharing controls, plan restrictions, or other technical or policy protections
- harass, threaten, or impersonate others
- reverse engineer or copy the Service except where law expressly allows
- resell or commercially exploit the Service without our written permission
We may suspend or terminate your account, or restrict or remove features, at any time and for any reason permitted by law, with or without notice. This includes cases where we reasonably believe you have violated these Terms or pose a risk to the Service or other users.
6. Copyright and academic integrity
afterhours is a study workspace. You must use it lawfully and in line with your school or university’s academic integrity policies.
You must not:
- upload, share, or store material you do not have the right to use, including copyrighted lecture slides, textbook excerpts, past exam papers, or other course materials distributed only to enrolled students, unless you have permission or another lawful basis
- use the Service to cheat, plagiarise, or misrepresent work as your own where your institution prohibits it, including submitting AI generated output as assessed work without permission where that is not allowed
- use the Service or any workaround, automation, shared account, or third party tool to bypass safeguards, misuse features, or help others do so
- use afterhours in any way that would reasonably be expected to breach copyright law or your institution’s academic integrity rules
We may remove content, restrict features, suspend or terminate accounts, and cooperate with rights holders or your institution where appropriate and permitted by law.
You are responsible for any academic, disciplinary, or financial consequences arising from your use of the Service if you breach these Terms. This includes, for example, fines or penalties from regulators, rights holders, or your institution. By using afterhours, you agree that you are solely responsible for such consequences.
7. Your content
You retain ownership of content you create or upload (“User Content”).
You grant us a worldwide, non exclusive licence to host, store, reproduce, display, and process User Content only as needed to operate, secure, backup, and improve the Service, including providing features you request (such as sharing or AI assisted tools).
You represent that you have the rights needed to submit User Content, that your uploads comply with copyright law, and that your use does not breach academic integrity rules or these Terms.
We may remove content that we reasonably believe violates these Terms, infringes third party rights, or creates legal or reputational risk.
8. AI assisted features
AI outputs may be inaccurate, incomplete, or unsuitable for your course. You are responsible for reviewing results before relying on them.
Do not use AI assisted features to produce work you submit as your own where your institution prohibits that.
Do not submit confidential, clinical, legal, or other sensitive information unless you accept the risk of processing described in our Privacy Policy.
We may apply usage limits to AI features according to your plan.
9. Plans, billing, and refunds
Paid plans, trials, and promotional access are described at checkout or in your account. Prices may change for future billing periods with notice where required.
Payments are processed by our payment provider. By subscribing, you authorise recurring charges until you cancel according to in product or checkout instructions.
Except where required by law or stated in a specific offer, fees are non refundable once a billing period has started. If you cancel, access typically continues until the end of the current paid period.
Complimentary or extended access granted by us may be modified or ended in line with the offer terms.
10. Enterprise and organisation accounts
If your access is provided by an organisation, additional terms in your organisation’s agreement with us may apply.
Organisation administrators may manage users, settings, and access within the scope of that agreement.
Questions about organisation billing or administration should be directed to your organisation’s designated contact as well as to us at the address below.
11. Our intellectual property
The Service, including software, design, branding, and documentation (excluding User Content), is owned by us or our licensors and protected by intellectual property laws.
We grant you a limited, personal, non transferable, revocable licence to use the Service in accordance with these Terms.
12. Third party services
The Service may link to or integrate with third party services. Those services are governed by their own terms and policies. We are not responsible for third party services we do not control.
13. Availability and changes
We aim to keep afterhours reliable but do not guarantee uninterrupted or error free operation. Maintenance, outages, and updates may occur.
We may modify or discontinue the Service or these Terms. Material changes will be posted on this page with an updated date.
Continued use after changes take effect constitutes acceptance, except where law requires additional consent.
14. Disclaimer
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non infringement.
We do not warrant that study results, grades, or outcomes will improve from use of the Service.
15. Limitation of liability
To the fullest extent permitted by New Zealand law, broke money and its directors, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or study outcomes arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) NZD $100, except where liability cannot be limited by law (including under the Consumer Guarantees Act 1993 where it applies).
16. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees and regulatory fines or penalties) arising from your User Content, your use of the Service, or your breach of these Terms (including copyright infringement or academic integrity violations), except to the extent caused by our wilful misconduct.
17. Termination
You may stop using the Service at any time and may request account deletion through account settings or by contacting us.
We may suspend or terminate your account, or restrict or remove features, at any time and for any reason permitted by law, with or without notice. This includes breach of these Terms, legal requirements, discontinuation of the Service, or action at our discretion.
Sections that by nature should survive termination will survive, including intellectual property, disclaimers, liability limits, and indemnity.
18. Governing law
These Terms are governed by the laws of New Zealand. You submit to the non exclusive jurisdiction of the courts of New Zealand for disputes, without limiting mandatory consumer protections that apply where you live.
